Terms of Use

1. Introduction and Acceptance

These Terms of Use (“Terms”) govern your access to and use of the Dream Photo mobile application and related services (collectively, the “Service”), operated by Dream Photo, (“we,” “us,” or “our”).

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms. We do not knowingly collect information from children under 13.

3. Account Registration

To use certain features, you must create an account using your email address or a supported third-party provider (such as Apple or Google Sign-In). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. Description of Service

Dream Photo is an AI-powered photo editing application. You can paint or brush over areas of a photo and provide text or voice instructions describing the desired edit. Your photo and instructions are processed by cloud-based artificial intelligence services to generate edited images.

5. User Content and License

You retain all ownership rights to the photos you upload (“User Content”). By using the Service, you grant us a limited, non-exclusive, worldwide license to process, store, and transmit your User Content solely to provide and improve the Service.

You represent that you have the necessary rights to any photos you upload, including the consent of any individuals depicted. You agree not to upload content that is illegal, infringing, or that violates the rights of any third party.

6. AI-Generated Content

Edits to your photos are produced by artificial intelligence. Results may vary and are not guaranteed to match your expectations. AI- generated outputs may contain imperfections or unexpected artifacts. We do not guarantee the accuracy, quality, or suitability of any AI-generated content.

7. Credits and Subscriptions

The Service uses a credit-based system. One credit is consumed per photo edit, regardless of edit type. You may receive free credits upon registration. Additional credits are available through subscription plans.

8. Subscription Terms (In-App Purchases)

Subscriptions are purchased through Apple In-App Purchase. By subscribing, you agree to the following:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
• You can manage or cancel your subscription at any time by going to your device's Settings > Apple ID > Subscriptions.
• No refund is provided for the unused portion of a subscription period. Refund requests should be directed to Apple in accordance with Apple's refund policies.
• Free trial periods, if offered, will automatically convert to a paid subscription unless cancelled before the trial ends.
• One-time credit pack purchases are final and non-refundable. Unused credits are forfeited upon account deletion.

9. Acceptable Use

You agree not to use the Service to:

• Upload, create, or distribute illegal, harmful, abusive, or sexually exploitative content, including child sexual abuse material (CSAM).
• Create deceptive deepfakes or content intended to mislead, defraud, or harass others.
• Violate the intellectual property or privacy rights of any third party.
• Reverse-engineer, decompile, or disassemble the Service or its underlying technology.
• Use automated means (bots, scrapers, etc.) to access or interact with the Service.
• Circumvent the credit system or any technical restrictions of the Service.

We reserve the right to remove content and suspend or terminate accounts that violate these terms at our sole discretion.

10. Intellectual Property

The Service, including its design, features, code, and branding, is owned by Dream Photo and protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership rights to you except the limited license to use the Service as described herein.

11. Third-Party Services

The Service relies on third-party infrastructure providers for cloud hosting, AI processing, and payment management. We are not responsible for outages, errors, or data practices of third-party providers. Your use of third-party services (such as Apple In-App Purchase) is governed by their respective terms and policies.

12. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DREAM PHOTO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Termination

We may suspend or terminate your account at any time if you violate these Terms. You may delete your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately, and we may delete your account data, including stored photos. Upon account deletion, any unused credits or active subscription benefits are forfeited and non-refundable.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil. Any disputes arising from or relating to these Terms shall be submitted to the competent courts of Brazil.

16. Apple-Specific Terms

If you access or use the Service through an Apple device, the following additional terms apply:

• These Terms are between you and Dream Photo only, and not with Apple Inc. (“Apple”). Apple is not responsible for the Service or its content.
• Apple has no obligation to provide any maintenance or support services with respect to the Service.
• In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by applicable law, Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims relating to the Service, including product liability claims, consumer protection claims, or intellectual property infringement claims.
• In the event of any third-party claim that the Service or your possession and use of the Service infringes that third party's intellectual property rights, Dream Photo, not Apple, shall be solely responsible for the investigation, defense, settlement, and discharge of such claim.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
